Where to Find Houghton County Family Court Records

Family court records in Houghton County are held by the Houghton County Circuit Court. The courthouse is located in Houghton, which sits in Michigan's Upper Peninsula along the Portage Lake waterway. The Circuit Court Family Division handles all domestic relations matters in the county, including divorce, child custody disputes, parenting time orders, child support, and paternity cases. All filings go to this court, so it is the right place to start any search for Houghton County family court records.

The circuit court clerk's office can pull case files for you to review in person and can make copies for a fee. You do not need an appointment to view records, but calling ahead is a good idea if you are looking for older files that may be stored off-site. The clerk's staff can tell you what information you need to locate a case. At minimum, have the full name of at least one party and an approximate filing year. A case number is even better and will speed up the process considerably.

Search Houghton County Family Court Records Online

The MiCOURT Case Search portal is the main online tool for searching Houghton County family court records. It is free and available any time. You can search by party name, case number, business name, or attorney name. MiCOURT shows basic case details: case numbers, filing dates, party names, scheduled hearings, current status, and the register of actions. It does not show document images. If you need the actual papers from a case file, you must contact the circuit court clerk.

MiCOURT covers family, civil, criminal, and probate cases from participating courts across Michigan's 83 counties. Most circuit courts participate fully. The portal excludes sealed records, adoption cases, juvenile delinquency files, and personal protection orders from public search results. These categories are restricted under state law. If a case does not appear in MiCOURT, it may be sealed, filed under a different name, or involve a restricted case type. In those situations, a direct visit or written request to the court is necessary.

Note: MiCOURT criminal case results only show records from the past seven years unless sentencing occurred within that window. Family court records do not have this same limit.

What Houghton County Family Court Files Include

Houghton County family court records contain a wide range of documents depending on the type of case. A divorce file typically holds the original complaint or petition, proof of service on the other party, any motions filed during the case, financial disclosure statements, and the final judgment of divorce. In contested cases, the file can grow to include hearing transcripts, guardian ad litem reports, and exhibits submitted by each side. Uncontested divorces tend to be much smaller files with just the basic pleadings and the signed judgment.

Custody and parenting time files hold the court's custody orders, the parenting time schedule, and any modifications made after the original order. If a case has been active for many years with multiple modifications, the file can be thick. Paternity files include the complaint, the order of filiation establishing the legal father, and related child support orders. Child support records in active cases are partly managed by the Friend of the Court office. For payment histories and enforcement actions, you may need to contact the FOC separately from the main circuit court file. The Friend of the Court Bureau can point you to the right local office if you are unsure where to go.

Adoption records are sealed under MCL 710.67. Juvenile records are restricted under MCL 712A.28. Neither will appear in a standard public records search.

How to Request Records from Houghton County Circuit Court

To request Houghton County family court records by mail, write a letter to the Houghton County Circuit Court Clerk. Include the full names of both parties, the case number if you have it, the approximate year the case was filed, and a clear list of the documents you want. Enclose a self-addressed stamped envelope for the court to return the copies. Include payment for the expected copy fees. Standard copies run $1.00 per page at most Michigan circuit courts. Certified copies cost $10.00 per document plus $1.00 per page. Call the clerk to confirm current rates before sending payment.

In-person visits are the fastest way to get records. Bring a valid government-issued photo ID such as a driver's license. You can view public case files at the courthouse for free under MCR 8.119. The court cannot charge just to look. You pay only when you want copies made. The clerk's staff can pull the file you need and direct you to the right records. For very old files, call ahead to ask whether the records are still on-site or have been moved to storage.

Certified copies must be picked up in person or delivered by mail. They cannot be sent by email or fax because they require an embossed court seal. Uncertified copies may be available by fax or email at some courts, but confirm with the Houghton County clerk before assuming that option is open.

Michigan Laws That Apply to Houghton County Records

Michigan's MCR 8.119 is the main court rule covering public access to court records. It says court records are public unless a statute, court rule, or specific order says otherwise. It also bars courts from charging a fee just to view records on site. Viewing is free. Copies are not. Copy fees in Michigan are set under MCL 600.2546. The Michigan Freedom of Information Act does not apply to court records. Courts are exempt under MCL 15.232. If a records request at a circuit court is denied, you file a motion with the court directly rather than a FOIA appeal.

The Michigan Legislature website at legislature.mi.gov carries the full text of all Michigan Compiled Laws, including the statutes that govern family court records, adoption confidentiality, juvenile record restrictions, and copy fee schedules. It is a good resource if you need to look up a specific statute before making a records request. Houghton County follows all state-level rules and court rules the same as every other Michigan county.

SCAO-approved forms for divorce, custody, paternity, and support cases are at courts.michigan.gov/scao-forms. Most circuit courts in Michigan, including Houghton County, require these standardized forms for family court filings. Using an unapproved version may result in a rejected filing.

Friend of the Court in Houghton County

Michigan law requires a Friend of the Court (FOC) office in every county. In Houghton County, the FOC operates under the supervision of the circuit court and handles child support enforcement, parenting time compliance, and custody recommendations when minor children are involved. The FOC keeps its own records separate from the main circuit court case file. If you need records tied to child support payments, enforcement actions, or compliance hearings, contact the Houghton County FOC directly rather than the circuit court clerk.

The FOC can start enforcement when support orders go unpaid. This includes wage garnishment, tax refund intercepts, driver's license suspension, and other tools under state law. If you want to modify a support order, a motion goes through the circuit court, but the FOC reviews and weighs in on any proposed changes. The Friend of the Court Bureau at the state level sets policy for all FOC offices and can direct you to the Houghton County office if you need contact details.

Note: FOC records are not available through MiCOURT. You must contact the FOC office directly for payment histories or enforcement records tied to a specific case.
